Finally she loses the battle to keep her eyes open, and with a soft sigh she slips into sleep.

He carefully closes the book, slipping a bookmark between the pages ready for the next evening, turns off her bed-side lamp and turns on her night-light.

He doesn't need to be able to see her, not really. But he is glad to have some light to show him the one perfect thing in his life; the only good thing to have come out of his marriage to Diane. Emily; his little girl. His beloved little angel, the person he would do anything for, go to any lengths for, fight for, lie for, even kill for.

Emily; his Emily. And he could all too easily have lost her. If it hadn't been for Jethro she might now be sleeping forever. He suppresses a shiver that passes through his body at the thought and wonders, not for the first time since he'd leaned his closest friend had also had a daughter whom he lost, how the hell Jethro lives with it. He's not certain he could.

Emily is the center of his world; in many ways she is his world. She's the reason he keeps fighting to try to make the world she'll grow up in just that little bit safer. She's the reason some mornings he even bothers to get out of bed. She's the reason his world looks just a little bit brighter. She's the reason he takes a little more care than he did at one time. She's the reason he is at least civil to Diane.

Emily; his Emily. His daughter. He came to fatherhood late in life, but now that's he's experienced it, he never wants to be without it. He wants to see her grow up; he wants to meet her first boyfriend. He wants to be there when she has her heart broken for the first time, because he knows, he knows no matter how much he loves her, how if he could he'd take all the hurts away, she will get hurt; it's all part of growing up. He wants to see her graduate; he wants to walk her down the aisle; he wants to be a grandfather.

He smiles to himself as he lets his fingertips gently touch her forehead. There she is only eight years old and he's already thinking about being a grandfather. As a Federal Agent he really should know better than to look too far ahead, and mostly he does. But when it comes to Emily, his little girl, his baby, well, even hardened Feds can have a soft side, can't they?

With one more look at her and another brush across her forehead, he stands up to leave her to sleep. But before he does, he bends over the bed and kisses her cheek. "I love you, Emily," he murmurs quietly before he leaves.

The love of a father; there really isn't anything quite like it in the world.

When you're a seasoned Federal Agent, it's not always easy to be optimistic; you start out that way. You believe you'll change the world; you'll right all the wrongs; you'll catch all the bad guys; you'll win.

But you soon learn that just because you carry a badge and gun and can yell 'Federal Agent. Freeze' at people, it doesn't change the world. In fact, you often think you make no damn difference at all. Sometimes you wonder why you go on doing the job; it certainly isn't for the pay or the hours or the gratitude or recognition.

So as he sits in his cell, staring at the stainless steel toilet bowl, wondering what his first night behind bars will be like, Tobias Fornell hadn't got a great deal to be optimistic about.

He was not in a good situation. In fact he couldn't remember ever being in a worse one, and that was saying something. He'd been framed, framed by one of his own. The FBI thought he was a mole; they thought he was the person who'd put his own man on the slab in Ducky's Autopsy. And there was not a lot he could do to prove them wrong.

In fact from where he was, he could do nothing. Nothing except wait. Nothing except wait and hope. Nothing except wait and hope and be optimistic. Nothing except wait and hope and be optimistic that Leroy Jethro Gibbs, the man who was a bigger bastard than he was himself, could prove the FBI wrong.

And not just prove them wrong, but save Fornell himself. Save his good name, his career and quite possibly his life. Federal Agents didn't do well in prison; a lot never saw the outside again. And those who did probably wished they never had, as they came out to nothing; no job, no home, no future. And it wasn't just their fellow prisoners who played a part in them not seeing the outside world; the legal system played its part too. Judges tended to hand out the maximum sentence possible and seemed to rely on less than sound evidence; a Fed gone bad had to made an example of.

Could Gibbs do it? Would he even try?

Yes. And yes. Fornell had no doubt about either fact. Sure Gibbs was a grade-A bastard, but he was also a damn good friend. The best Fornell had. Sure they bickered at one another, even when they were alone. Fornell's 'realizing how sad this sounds, you’re the closet thing I have to a friend, Gibbs' had just been part of their game; the way they handled their friendship.

Gibbs would get him out of there.

He would save him.

He would find a way to prove Fornell's innocence.

Fornell knew he would.

When you're a seasoned Federal Agent, it's not always easy to be optimistic. Well, not unless you have one Leroy Jethro Gibbs on your side. Then it's the easiest thing in the world.

If he thought about it, Tobias Fornell would have problems pinning down exactly what had made him become a Federal Agent. In particular why he had decided on the Federal Bureau of Investigation, rather than one of the other agencies.

He guessed it was a matter of elimination: he'd never wanted to be a 'navy cop' or to spend time investigating foreign governments, corporations, etc. He preferred to work in domestic crime, rather than foreign.

Looking back he feels he'd almost stumbled into a career as a Fed. He'd graduated High School and then college with only the vaguest idea that he wanted to work in some kind of law enforcement.

So why the FBI?

And why had he stayed?

The hours weren't good; although if he was honest for the last seven years, ever since Diane had walked out, taking his adored Emily with him, he'd found the hours had bothered him less. At least they meant he didn't have to spend too much time alone in a quiet and lonely house.

The pay wasn't bad, not unless he stopped to really think about the hours, the pressure, the stress, the loss of life, the being shot at and shooting at people. But these days, since his move to Homeland Security, he was spending less time with a gun and more time with a computer.

The benefits were good: he got health insurance, life insurance, and in a few years he'd get a decent pension. Leave wasn't great, but then he didn't have anyone to spend time off with anyway.

He didn't need to think about what he'd wear each day, he simply donned 'the suit, white shirt and tie' – it made mornings easy.

He was pretty well respected now, kept up the personae of being a bastard; he didn't let anyone get too close – it didn't really pay in his line of work to do so. He did his job; he helped keep America safe. And if he got too tired of his own company in the rare evening he couldn't find an excuse to stay at the office, he knew one front door that was always open to him.

But even with all the benefits, both those directly given by the FBI and those he'd gathered for himself, it really still didn’t explain the draw of the job. He could, in fact, have retired already, but he'd stayed. And it wasn't just because if he did retire he had no idea what he'd do.

It was like the reason he'd become an FBI agent in the first place, the reason he put up with being shot at, of losing team members, of being accused of being a mole, of taking life, of the long hours. It was the X-Factor; the unknown; the thing you couldn't put your finger on. The thing you probably didn't even want to put your finger on, not really.

That was why he'd gotten into the Bureau and that was why he stayed.
